TERMS AND CONDITIONS
These Terms and Conditions constitute a legally binding contract between the adult consumer (“you”) and N Plus Europe GmBH trading as N+ Volkswagen (“N+ Volkswagen”) and apply to the ordering, purchasing, fulfillment, and delivery of Goods from N+ Volkswagen including from the top-level domain name ride-volkswagen.com (“Website”). This policy applies only to individuals who purchase cycling goods for personal use (not business or wholesale accounts).

Please read the following Terms and Conditions carefully before placing your Order. By accessing the Website, you agree to be bound by these Terms and Conditions.

If you breach any of the Terms and Conditions, you are prohibited from continuing to use the Website. If you do not agree with any part of these Terms and Conditions, you must leave the Website immediately.

These Terms and Conditions may be updated periodically by N+ Volkswagen. You agree to be bound by any revisions posted on this page.

DEFINITIONS
• Consumer: An adult individual who purchases goods and services for personal use and not for business purposes.
• Goods: Goods available from N+ Volkswagen via the Website.
• Order: An order for Goods placed via the Website or other means.
• Taxes: Any taxes (including goods and services tax, VAT), levies, imports, charges, and duties imposed by any authority, along with any related interest, penalties, fines, and expenses.

COMMUNICATION BY US
By creating an account with N+ Volkswagen, you consent to receiving Administrative Emails (account activity, Orders, offers, purchases) and Promotional Emails (Goods information, offers, updates). You may opt-out of Promotional Emails at any time.

PLACING YOUR ORDER AND FORMING A CONTRACT
1. Our offerings on the Website, in catalogues, and in our Showroom are non-binding.
2. By placing an Order on the Website (requires registration and acceptance of Terms), you make a binding offer to purchase Goods. The offer remains valid until either 5 calendar days have passed or full deposit payment is received.
3. We will send a confirmation of Order by email. Acceptance occurs once the deposit is received, by email confirmation, or by dispatching the Goods (tracking info available on request).
4. We reserve the right to terminate or not accept Orders pending internal validation (fraud checks and supplier confirmation).
5. Designs and colors of Goods may vary from website images.
6. You warrant that all Goods are for personal, recreational, domestic, and non-commercial use only.
7. You will be considered the importer of record unless otherwise stated and must comply with all laws and regulations of your country, including payment of Taxes.
8. N+ Volkswagen reserves the right to refuse service, terminate contracts, or cancel Orders at its discretion.

PRICES AND PAYMENT
1. Prices include VAT, GST, and other applicable taxes, shipping costs, and foreign exchange once the shipping address is known.
2. All shipments require advance payment unless otherwise agreed.
3. Purchases in foreign currencies may incur conversion fees. Chargebacks may result in termination of service.
4. If we cannot process your Order, we will contact you via email or phone.
5. No set-off or retention rights except as legally permitted.

DISPATCH OF GOODS
1. Orders will be manufactured-on-demand; delivery may vary for non-standard Orders.
2. If Goods are unavailable, we will inform you and attempt alternative arrangements or reimburse payments.
3. Partial deliveries are permitted if Goods can be used separately.

RETENTION OF TITLE AND RESALE
Title remains with N+ Volkswagen until full payment (including Taxes and shipping costs) is received. This creates a security interest under applicable law.

WARRANTY, GUARANTEE, RETURN POLICY
Your statutory rights under relevant consumer laws are unaffected.
1. Warranty covers structural defects in workmanship or materials at delivery. Defective Goods may be repaired or replaced. Normal wear and tear is excluded.

Warranty period starts from the date of Order. All other consumables not listed are excluded.

1. Warranty conditions: misuse, neglect, unapproved modifications, crash, jumps, or excessive loads are excluded.
2. We may repair or replace Goods or substitute models where required. Original colour may not always be available.
3. Costs for assembly, transport, duties, or model-change are borne by the Consumer.
4. Warranty is valid only for the original Consumer.

RETURNS POLICY
14-day return policy excluding Custom Orders (Limited Editions, road bikes, altered Goods). Goods must be returned in original condition, packaging, and unused. Proof of shipping required. Refunds processed after inspection; deductions may apply for damage or altered condition.

WAIVER, INDEMNITY AND LIABILITY
• You must use Goods in compliance with applicable laws.
• You indemnify N+ Volkswagen from claims or liabilities arising from unlawful use, including exceeding speed or power limits.

GENERAL LIABILITY
• Liability is limited to the maximum extent permitted by law.
• Damage claims excluded unless reported within 14 days of delivery.
• Goods and website material provided “as is”; N+ Volkswagen disclaims liability for indirect or unforeseeable damages.

YOUR RESPONSIBILITIES
• Over 18 years old.
• No posting or transmitting unlawful, offensive, or infringing content.
• No hacking or unauthorized access.
• N+ Volkswagen may use submitted content freely.

CREDIT CARD FRAUD
N+ Volkswagen employs technology to protect transactions. We are not responsible for unauthorized use of credit cards.

SUPPLY, PRODUCTION, AND DELIVERY
• Goods manufactured and delivered according to estimated dates.
• Some assembly required by Consumer; professional fitting recommended.
• Delivery times are estimates and non-binding.
• Risk and title pass to you upon delivery to the carrier. Inspect immediately and report issues within 24 hours.

IMPORTER OF RECORD AND CUSTOMS
• You are the importer of record for taxes, duties, and compliance with local law.

REFUND PAYMENTS POLICY
Refunds will be made to the original payment method. Bank refunds may take additional processing time.

GENERAL
• Terms cannot be assigned without written consent.
• Statutory rights remain unaffected.
• Terms may change at any time; employees cannot override these Terms.

FORCE MAJEURE
N+ Volkswagen is not liable for delays outside its control.

GOVERNING LAW AND SEVERABILITY
This contract will be governed by the laws of the appropriate nation. Any dispute arising out of your use of the Website, or the Goods purchased on it shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.

If a provision of these Terms and Conditions is or becomes illegal, invalid or unenforceable that shall not affect the validity or enforceability of any other provision.
